TERMS AND CONDITIONS OF ENTRY DC SHOES / RUSH SURF PROMOTION

Information on prizes and how to enter form part of these conditions of entry.
The Promoter is DC Shoes Australia Pty Ltd. ABN 12 104 106 667
The competition starts on 24 November 2008 at 9am AEST and ends on 24 December at 5.30pm AEST [“Promotion Period”}.
Entry is open to all residents of Australia. Entrants under 14 years of age must have a parent or guardian’s permission before providing personal information.
Employees, licensees and contractors of the Promoter and the agencies associated with the competition (and their families) cannot enter. Proof of identity must be furnished upon request.
To enter the promotion customers must purchase any DC shoes from any Rush Surf store in NSW, QLD or the NT during the Promotion Period and complete a valid entry form provided by the store which includes their name, address, phone number, receipt number and store location relevant to their purchase and answer in 10 words or less to the question “What does DC mean to you?”. Completed entry forms must be placed in boxes located in the stores. Only one entry form per transaction will be accepted. No responsibility accepted for lost, late or misdirected entries. Limit of one entry per person. A lay by does not constitute a valid purchase unless the customer pays all monies outstanding on the lay by item within the Promotion Period. Return of a purchase (other than under a non-excludable statutory warranty) will invalidate the entry for that purchase.
The best entry will win a years supply of DC shoes (12 pairs) (“Prize”). The maximum total value of the Prize is $1,800. The Promoter takes no responsibility for any variation in the Prize value.
Members of the marketing team of the Promoter will select the winning entry (judged on the 10 word or less submission) on 15 January 2009 at 27 Baines Crescent, Torquay VIC 3228.
As a condition of entry, all entrants agree to be bound by the decisions of the Promoter, which shall be final and binding in all matters relating to the Promotion. No correspondence will be entered in to. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the creative merit of the answer provided to the question. Incomplete, indecipherable, or illegible entries will be deemed invalid.
The winner will be notified by telephone and/or email within 24 hours of selection. The winner’s name and suburb of residence will also be published on the Promoter’s website at www.dcshoes.com.
If the Prize remains unclaimed, the Promoter may conduct such further draws as necessary on Friday 17 April 2009 in order to distribute the unclaimed Prize. The Promoter’s decision is final and no correspondence will be entered into.
The winner may be asked to produce evidence of Australian residency and their original Rush Surf store purchase receipt. Failure to produce such evidence and proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of the winner’s entry and forfeiture of any right to a Prize. The Promoter reserves the right to disqualify any person found to be in violation of any term contained in these rules.
The Prize is not transferable or exchangeable and cannot be taken as cash. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute that Prize (or that part of that Prize) with a prize to the equal value and/or specification.
All entries become the property of the Promoter. Entries will not be returned to entrants and may be used by the Promoter in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes without further notice or remuneration.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose disclose such information to third parties, including, but not limited to, RUSH Lifestyle Australia Pty Ltd (ABN11 803 286 869), trading as Rush Surf. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes. The personal information of entrants will be held and used in accordance with the Promoter’s Privacy Policy, which is available at www.dcshoes.com.
Entry into the competition shall be deemed acceptance of the above conditions of entry and is deemed approval of use by the Promoter and RUSH Lifestyle Australia Pty Ltd of the winner’s name, suburb of residence and photograph for publicity purposes.
